Se analiza los alcances del control por el juez constitucional del principio-derecho a la motivación de resoluciones judiciales, a propósito de definir si hubo una debida justificación al dilucidar si una determinada pretensión debía ser conocida, o no, por la vía civil; no obstante ello, se precisa que lo decidido por la justicia constitucional no puede afectar la aplicación del derecho ordinario.

ABSTRACT

The scope of the control by the constitutional judge of the principle-right to the motivation of judicial decisions is analyzed, in order to define whether there was a due justification in determining whether a certain claim should be known, or not, through civil law; however, it is specified that what is decided by the constitutional justice cannot affect the application of ordinary law.
