Resumen

A juicio del autor, la sentencia del Tribunal Constitucional resuelve el dilema a propósito de la situación del propietario frente al tercero de buena fe, decantándose por este último, no sin antes incorporar un mayor y estricto estándar de conducta al tercero, el cual no solo se limitará a la publicidad registral, sino a otro indicador como la verificación del inmueble materia de adquisición.

ABSTRACT

In the author’s opinion, the Constitutional Court ruling resolves the dilemma regarding the situation of the owner vis-à-vis the third party in good faith, opting for the latter, but not without first incorporating a higher and strict standard of conduct for the third party, which not only it will be limited to registration advertising, but to another indicator such as the verification of the property subject to acquisition.
