RESUMEN

El autor sostiene que un proceso de ejecución de garantía abierta la obligación exigida puede hallarse fuera del título hipotecario; sin embargo, solo puede obrar en un documento que tenga la calidad de título ejecutivo, lo que debe ser advertido por el juez incluso en la fase de calificación.
