RESUMEN

Al resolver un proceso de tercería de propiedad, los jueces deben analizar la pertinencia de la aplicación del precedente establecido en el Séptimo Pleno Casatorio o, en su caso, motivar las razones del eventual apartamiento de sus reglas para evitar ser sujetos de responsabilidad civil y administrativa.
