RESUMEN

Se reflexiona sobre los siguientes puntos: ¿la situación jurídica derivada de la duplicidad de partidas se podría o no resolver solo con los principios de preferencia registral?, ¿el reconocimiento o declaración judicial de la propiedad a un solo titular podría implicar o no la nulidad de la titularidad de la propiedad al otro titular?, ¿el título y acreditación de la propiedad del bien serían los elementos necesarios o no para peticionar el mejor derecho de propiedad?, entre otros.

ABSTRACT

It reflects on the following points: the legal situation derived from the duplicity of items could or could not be solved only with the principles of registry preference? The recognition or judicial declaration of the property to a single owner could imply or not the nullity from the ownership of the property to the other owner?
