RESUMEN
El autor considera correcto que se privilegie el derecho de propiedad por sobre el derecho de crédito en aplicación del VII Pleno Casatorio; pero cuestiona que en la sentencia no se haya precisado que el fin de la tercería es la desafectación, y no la suspensión de la medida cautelar.
