RESUMEN

Se reflexiona en este artículo sobre: ¿Si se puede equiparar el anticipo de legítima con la colación hereditaria?, ¿si se puede disponer en anticipo de herencia el “total” de la herencia?, o si ¿el beneficiario con el anticipo de herencia puede disponer plenamente del bien anticipado?, entre otros.

1. Naturaleza jurídica del anticipo de legítima

Siguiendo a Augusto Ferrero1, el anticipo de legítima sería lo que se denomina como contrato de donación, en el que intervienen dos sujetos: el donante y donatario; pero que ha sido concebido erróneamente como anticipo de legítima porque los sujetos intervinientes tienen un vínculo familiar (filial, conyugal o de unión de hecho declarada: herederos forzosos). 1.
