Resumen


En el presente trabajo se cuestiona que, a pesar de que la unión de hecho debidamente inscrita cumple los mismos fines que la unión matrimonial, todavía existe normativa que no haya sido perfeccionada para facilitar el acceso de aquella a la constitución de un patrimonio familiar. En ese sentido, y en atención al principio de igualdad, se aconseja flexibilizar la taxatividad del artículo 495 del Código Civil que excluye su invocación por las uniones no matrimoniales.

ABSTRACT

In the present work it is questioned that, despite the fact that the duly registered de facto union fulfills the same purposes as the matrimonial union, there are still regulations that have not been perfected to facilitate the access of the former to the constitution of a family patrimony. In this sense, and in attention to the principle of equality, it is advisable to make the exhaustiveness of article 495 of the Civil Code more flexible, which excludes its invocation by non-marital unions.
